These Sales & Shipping Terms apply to purchases made through cemaxecuter.com. They supplement, and are read together with, the WarDragon & DragonScope Terms of Use and Product License Agreement (the “Product Terms”), which control in the event of any conflict.
1. Pricing. All prices are in U.S. Dollars (USD) and are subject to change until an order is placed.
2. Payment. Payment is due at checkout through the payment methods offered on the Site. Purchases made by quote or purchase order are governed by the Millenium Products Sales Terms & Conditions.
3. Order Acceptance. Your order is an offer to purchase; our order confirmation constitutes acceptance. We may cancel or refuse an order — for example, in cases of suspected fraud or a pricing error — in which case any amounts paid for the cancelled order will be refunded in full.
4. Shipping. Shipping timelines shown at checkout are estimates. Risk of loss passes to the carrier upon our delivery of the shipment to the carrier. International orders are subject to export-compliance review and may be cancelled and refunded if the order cannot lawfully be fulfilled.
5. Returns. All sales are final, as provided in the Product Terms. Defects in materials and workmanship are handled under the ninety (90) day limited hardware warranty described in the Product Terms.
6. Licensed Services. Purchases of the DragonScope service are additionally subject to the DragonScope Service Agreement, available in the Legal menu, which controls with respect to that service.
7. Export Compliance. Products may be subject to U.S. export-control and sanctions laws, including the Export Administration Regulations (EAR) and applicable OFAC sanctions programs. The purchaser agrees not to export, re-export, transfer, or use any product or technical data in violation of those laws.
8. Taxes. The purchaser is responsible for all applicable taxes, duties, customs, and government fees, or must provide valid exemption documentation.
9. Governing Terms. These Sales & Shipping Terms are governed by the laws of the State of Florida. The Product Terms, including their warranty disclaimers and limitations of liability, apply to every purchase.
